GRIPTECH Warranty Policy

V1.0 - 27.08.24

Preamble

All GRIPTECH products are sold with consumer rights under Australian Consumer Law. You are entitled to a range of remedies in case of the failure or fault, which GRIPTECH will proudly honour. Please note that while there is a baseline legal protection you are afforded under Australian Law, the intention of the warranty terms below is to exceed your expectations wherever possible. As you will see below, the faith we have in our processes and products allows us to extend cover well beyond what is common or mainstream for our products.

Terminology

Roll bar, anti-roll bar, stabilizer bar, sway bar, and anti-sway bar — These are all terms used to describe a mechanical component in a vehicle's suspension system, typically a metal bar, designed to resist body roll or sway during cornering and other lateral loading situations. It dynamically counteracts the lateral forces acting on the vehicle, enhancing stability and handling by limiting lean or sway. We respect your choice of terminology, but for the remainder of this document, we will use the term sway bar.

GRIPTECH Lifetime Warranty: Sway Bars

Coverage: GRIPTECH sway bars are covered by a lifetime warranty against all manufacturing defects, material faults, and workmanship. Motorsport, Four Wheel Driving and off-road use is covered by this warranty, please refer to our Motorsport and offroad use statement.

Exclusions:

• This warranty does not cover the appearance and cosmetics of the sway bar.
• The warranty does not apply to sway bars that have been poorly or incorrectly fitted.
• The warranty is non-transferable and applies only to the original purchaser.
• This warranty does not cover freight or labour, or costs associated with removal and fitting of GRIPTECH products.
• Commercial or industrial use is not covered under this warranty. For more details, please refer to our Commercial and Industrial Use Statement.
• Custom and prototype sway bars may not be covered by this warranty. Please Refer to our Custom and prototype statement.

Bushes, Links, Mounts and Accessories Warranty

Coverage: GRIPTECH bushes, mounts and connecting links are covered by a 3-year or 60,000 km warranty, whichever comes first. This warranty covers all manufacturing defects, material faults, and workmanship.

Exclusions:

• The warranty does not apply to products that have been poorly or incorrectly fitted.
• Commercial, or industrial use is not covered by this warranty. Please refer to our Commercial and industrial use Statement.
• Custom and prototype sway bars may not be covered by this warranty. Please Refer to our Custom and prototype statement.
• This warranty is non-transferable and applies only to the original purchaser.
• This warranty does not cover freight or labour costs. Please refer to our Labour and Associated Costs Statement.

Motorsport and Offroad Use Statement

Coverage: GRIPTECH sway bars, bushes, and connecting links, designed for high performance and heavy-duty applications, are fully covered under these warranty terms when used in motorsport or 4WD applications, provided they are correctly fitted and used as intended.

Custom and prototype statement

Coverage: While GRIPTECH strives to cover custom and prototype sway bars under warranty, coverage may be limited due to the unique nature of these products, especially if they were not designed or specified by GRIPTECH. We will provide as much assistance as possible, but there are limitations to our support.

Exclusions: This warranty does not apply if the custom or prototype sway bar has been used incorrectly or for purposes other than its intended design.

If a mechanical failure or premature wear occurs due to GRIPTECH components and it is not obviously due to incorrect application, we will cover the issue under warranty.

Responsibility for the product's performance in untested or unique applications resides with the customer.

Commercial and Industrial Use Statement

Coverage: GRIPTECH products used in commercial or industrial applications are not covered under our standard warranty terms due to the unknown and varied conditions in these environments. To assist with any aftersales support for products used in commercial or industrial applications, GRIPTECH requires proof of purchase and proof of mileage..

Legal Obligations: We will honour any obligations under Australian Consumer Law for products used in commercial or industrial settings.

GRIPTECH Fair Go Policy

At GRIPTECH, we believe in a fair go. If you encounter an issue, even if it’s due to a mistake or uncertainty on your part, we encourage you to get in touch with us. Our priority is to ensure you’re back on the road with the best possible solution, and we’ll do our utmost to help, no matter the situation.

Data is Everything and Details are Key. We believe in working together, and that means we value your feedback. Please share any data, intelligence, or insights you have on the performance of our products in real-world conditions.

These warranties are in addition to your rights and remedies under Australian law in relation to the goods or services to which the warranties relate.

Additional Warranty Terms

Finishings: Lifetime Warranties do not cover the plating, powder coating, or other finishings of GRIPTECH products.

Custom sway bars: GRIPTECH will take all care to work with the customer on custom application guidelines and advice. However, our ability to guarantee service life and performance is limited to our understanding of the application and your diligence in following our advice. The responsibility for the product's performance ultimately resides with the customer.

Warranty Claims: In the event of a warranty claim, the purchaser must contact GRIPTECH before returning the defective product, along with proof of purchase. If the product is found to be defective and covered by the warranty, it will be replaced free of charge. Please note that freight, Labor, or costs associated with the fitment or removal of components are not covered under this warranty.

GRIPTECH requires Products must be returned to us in the case of a claim. If a suspension component is deemed defective, it is critical the item be removed from service and moreover, the GRIPTECH commitment to product and process improvement requires internal fault analysis.

However, as a growing global brand, we recognize the need for clear trading terms to ensure mutual understanding and protection for both our business and our valued customers. GRIPTECH Industries operates globally, providing high-quality automotive components. These trading terms outline the conditions under which we conduct our business. By placing an order with us, you agree to comply with these terms.

Pricing and Payment

All prices listed on our website or provided in quotations are in Australian dollars (AUD) unless otherwise specified. GRIPTECH Industries reserves the right to change prices at any time without prior notice. In the event of a price change, customers will be notified before processing their order. All payments must be made in full at the time of order placement unless alternative arrangements have been agreed upon in writing.

Order Acceptance and Cancellation

GRIPTECH Industries reserves the right to accept or reject any order at its discretion. We may cancel any order, in whole or in part, for any reason, including but not limited to the unavailability of stock, errors in pricing or product descriptions, or suspected fraudulent activity. If an order is canceled, we will provide a full refund for any payments made.

Changes to Orders

Once an order has been placed and confirmed, any requests for changes or modifications must be made promptly. GRIPTECH Industries will make reasonable efforts to accommodate changes, but we cannot guarantee that all requests will be fulfilled. Additional charges may apply for any changes made after the order has been processed.

Title of Goods

Ownership of goods transfers to the customer only upon full payment of the order. Until payment is received in full, GRIPTECH Industries retains title to the goods. Risk of loss or damage to the goods passes to the customer upon delivery to the shipping carrier. Customers are responsible for ensuring proper handling and storage of the goods upon receipt.

Use of Digital Assets

All digital assets provided by GRIPTECH Industries, including but not limited to product names, part numbers, descriptions, and images, are protected by intellectual property laws. The use of these assets is strictly limited to authorized parties with written permission from GRIPTECH Industries. We reserve the right to limit reseller activity to the extent permitted by applicable laws. Only businesses with written approval from GRIPTECH Industries may resell our products online or through any brick-and-mortar store. Unauthorized use or distribution of our digital assets is prohibited and may result in legal action.

Shipping and Delivery

Shipping terms and conditions are outlined in our Shipping Policy. GRIPTECH Industries is not responsible for delays or damages caused by third-party carriers. Customers are responsible for all shipping and handling fees, including any customs duties, taxes, or import fees for international orders.

Returns and Exchanges

Returns and exchanges are managed on a case-by-case basis, as detailed in our Shipping Policy. Any return or exchange request must be approved by GRIPTECH Industries prior to the return of goods. Unauthorized returns will not be accepted.

Warranty and Liability

GRIPTECH Industries provides warranties on its products as specified in our Warranty Policy. We are not liable for any indirect, incidental, or consequential damages arising from the use of our products. Our liability is limited to the replacement or repair of defective products under warranty.

Compliance with Laws

GRIPTECH Industries is committed to complying with all applicable laws and regulations in every region where we operate. Customers are responsible for ensuring that their use of our products complies with local laws and regulations.

Changes to Trading Terms

GRIPTECH Industries reserves the right to amend these trading terms at any time. Any changes will be effective immediately upon posting to our website. Customers are encouraged to review these terms regularly to stay informed of any updates.

Governing Law

These trading terms are governed by the laws of Australia. Any disputes arising under these terms will be subject to the exclusive jurisdiction of the courts of Australia.
